HOURLYPAL TERMS OF SERVICE, USE AND TERMS AND CONDITIONS.

· Hourly PAL: Hourly PAL means, hourlypal.com, the HourlyPAL APP’s and the personal services marketplace provided by them collectively and singularly. The term “we” means all of the above and the limited liability company that owns HourlyPAL; and its officers, successors and assigns.

· Services Provided: HourlyPAL provides a marketplace for personal services, in which providers can list services provided; and clients can search for service providers and schedule appointments in a secure, private medium.  HourlyPAL provides a masked in-APP communication system allowing users to schedule appointments acceptable to both parties.  Initial contact is via SMS or email to a user’s HourlyPAL account, with forwarding to their individual private account that is not on the HourlyPAL APP.  Once parties leave the in-APP communication HourlyPAL any of the users communications.

HourlyPAL verifies the registered users are real people.  We do not warrant representations made by anyone on our APP.  Like you, we rely on the honest statements and good intentions of users.  It is your sole responsibility to determine if the provider or client is in your judgement trustworthy prior to sharing your personal details beyond your HourlyPAL profile.

IMPORTANT: You agree to hold harmless HourlyPAL, from any dispute, harassment or claim made against or by you, either on our APP or from a resulting appointment or subsequent interaction.   Your interactions with others on or off the APP are your individual responsibility.

· Acceptable Use: Users of HourlyPAL warrant that they will only use the marketplace services for legal purposes, that they are at least eighteen (18) years of age and that they, nor any member of their household has been charged with domestic violence; nor convicted of a felony. Users of HourlyPAL will not violate HourlyPAL’s intellectual property rights in any manner and will observe HourlyPAL’s trademark, copyrights and rights of first use, in any jurisdiction worldwide.

· Account Termination: You will be able to terminate your account and subscription in a manner similar to your registration.  HourlyPAL reseves the right to cancel your account in our sole discretion, without any recourse on your part.

· Limitation of Liability: You agree that HourlyPAL’s limit of liability is limited to the amount of your paid subscription or $25.00, whichever is greater.  You also agree that you waive any rights you may have to participate in a class action lawsuitagainst HourlyPAL.

· Governing Law: The terms of service agreement is governed by the laws of the State of Florida.  Venue for any legal action shall be Duval County, Florida.

· Complaints: You may file a complaint regarding bad behavior, and we will block an abuser’s access to your profile on the APP.  HourlyPAL reserves the right to cancel a subscription based upon a complaint or violation of terms of service or any harassment of other users. Such cancellation is in our sole discretion and without any refund of fees paid.

· Privacy Policy Link: HourlyPAL respects your privacy. 

· We will not:

o Share your name, address, contact information or personal details other than what you have in your HourlyPAL profile with any other users. 

o Share your name, address, contact information or personal details with any other users. 

· We may:

o Share aggregated data on users’ zip code and service provided, and services solicited with third parties to improve HourlyPAL’s business effectiveness.

o Share aggregated data on user’s zip code and service provided, and services solicited with third party advertisers.  You may opt out of this provision at any time.

In full recognition and understanding of the terms of use, I agree to the terms above and accept the Quid Pro Quo between HourlyPAL and myself.
